OKLAHOMA CITY -- There is a bill in the works at our state capital that would make it illegal to talk or text on a cell phone while driving. An Oklahoma City cyclist has taken up the cause because she was nearly killed last week by a driver she suspects was texting while driving. Dawn Harth is an avid cyclist. She was riding along Britton Road in Oklahoma City when a driver hit her from behind and then drove off.

The force of the blow broke the side-mirror off the suspect vehicle; Harth recovered the broken car parts.

Her husband camped out on Britton Road and waited for the suspect car to return.

Sure enough, a car matching the make and model of the mirror drove by.

The green 2002 Kia Rio was missing the passenger side-mirror.

Harth's husband chased the car into Edmond. According to Harth's husband the woman behind the wheel appeared be in her twenties and was driving without her hands on the wheel, he says she speeding and texting the entire time.

The Harth's have filed a police report. However, Oklahoma City Police told them the driver will likely not face charges because Harth was not more seriously injured.

Dawn Harth says, "I just want people to be aware about the dangers of texting while driving, not just from the cycling perspective, but for other cars as well. You could kill someone!"
